STANDARD TERMS AND CONDITIONS OF SALE

  1. Application
    The client explicitly waives its own standard terms and conditions, even if these were established after the present terms and conditions of sale. Any derogation will only be valid if expressly agreed to in writing by Estampaciones Magenta.
  2. Payment Terms
    • All orders must be paid in full prior to commencement of work, production, or delivery.
    • No services or goods will be delivered until payment has been received in cleared funds.
    • In the event of late or incomplete payment, Estampaciones Magenta reserves the right to withhold or cancel the order without liability.
  3. Debt Recovery
    • If payment remains outstanding after invoicing and reminder, Estampaciones Magenta may engage a debt recovery agency.
    • All related legal and collection costs will be borne by the client.
  4. Withholding Tax
    • Some jurisdictions impose withholding at source on invoices.
    • Any such withholding must be paid by the client directly to the relevant tax authority.
    • Estampaciones Magenta invoices must be paid in full, free of any such deductions.
  5. Provision of Services
    • Estampaciones Magenta undertakes to provide services with due care and in accordance with agreed timelines.
    • Obligations are best-effort commitments, not obligations of result.
    • Estampaciones Magenta cannot be required to act as a third party in claims for damages brought by the client’s end customers.
  6. Refunds and Returns
    • Standard products may be eligible for return or exchange in accordance with applicable consumer protection laws.
    • Customized or branded items are strictly non-refundable and cannot be exchanged, provided that the delivered goods conform to the approved customization board agreed with the client prior to production.
  7. Claims and Complaints
    • Any claim must be notified in writing by registered letter to the company’s registered office within 8 days of goods delivery or service provision.
    • Claims made after this period will not be considered.
  8. Governing Law and Jurisdiction
    • All contractual relations shall be governed exclusively by the laws of Spain.
    • Any dispute arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Palma de Mallorca, Spain.
